Hamas, which is Israel's mercenary army, did not enter Israel, it entered Palestine. It did so with Israel activating the
Hannibal Directive
Under the Fourth Geneva Convention (1949), particularly Article 49, it is clearly stated:
“The Occupying Power shall not deport or transfer parts of its own civilian population into the territory it occupies.”
This means that when a country occupies land through military force, it is prohibited from transferring its own civilian population into that territory.
Why It’s Considered a War Crime:
- The transfer of the occupier's population into occupied land can alter the demographic makeup of the area.
- It can lead to long-term changes in the territory's legal and political status, often undermining the rights and claims of the original population.
- It can also contribute to systematic discrimination, displacement, or violence.
Enforcement and Prosecution:
- The International Criminal Court (ICC) recognizes such transfers as war crimes under Article 8(2)(b)(viii) of the Rome Statute.
- Prosecutions can occur, but often depend on international political will, the cooperation of states, and jurisdictional considerations.
